If a VAT-registered company does not file its UAE VAT return by the applicable deadline, the filing obligation remains outstanding and administrative penalties can apply. If VAT is also unpaid, separate late-payment consequences may arise under the current tax procedures rules. The practical response is to reconcile the period, submit the overdue return, settle the tax position and preserve the working papers rather than allowing the backlog to grow.
Does a missed VAT deadline make the return disappear?
No. The return remains due. A business should not wait for an FTA reminder before dealing with the period. As more periods become overdue, the practical problem becomes harder because each return depends on reconciled records, opening balances and corrections from earlier periods.
The business should therefore treat a missed return as an immediate remediation task: establish which periods are outstanding, reconcile the books, prepare the return and settle the payment position.
What is the administrative penalty for a late VAT return?
The UAE administrative penalty schedule provides a fixed penalty for failing to submit a tax return within the legally specified timeframe: AED 1,000 for a first violation and AED 2,000 on repetition within the applicable repeat period.
What if the company also has VAT payable?
The FTA requires the related VAT payment within the same general 28-day period as the return. If the return is late and the tax is also unpaid, the business can face separate late-payment consequences under the current tax procedures and administrative penalty rules.
For that reason, the recovery plan should calculate the expected VAT payable at the same time as the return is prepared. Filing an overdue return without understanding the payment position leaves part of the compliance problem unresolved.
Does a VAT-registered company need to file a nil return?
Yes, where a return is due for the assigned tax period, the fact that there are no amounts to declare does not by itself remove the filing obligation. The FTA VAT Returns User Guide instructs taxpayers to use “0” where necessary and where there are no amounts to be declared.
If the business has stopped making taxable supplies or believes it should no longer remain VAT-registered, that is a separate deregistration question. The business should not simply stop filing returns without resolving its registration status.
Can repeated non-filing lead to wider FTA action?
Persistent non-compliance can lead to FTA enquiries, assessments and enforcement under the Tax Procedures framework. The authority can request information and review the taxpayer’s records when determining the correct tax position.
For that reason, it is better to remediate the missing period from a reconciled working file than to submit a rushed return that creates a second issue around inaccurate reporting.
How should a company fix a missed VAT return?
What if a VAT return was filed, but filed incorrectly?
An incorrect submitted return is different from a return that was never filed. The business should reconcile the original submission to its accounting records, identify the affected VAT boxes and tax period, and calculate whether the error changes the tax payable or refundable. Depending on the nature, value and timing of the error, the appropriate route may be correction through a later VAT return or submission of a VAT211 Voluntary Disclosure.
Do not correct figures blindly or wait for an FTA audit. Keep the original and corrected calculations, invoices, ledgers and decision record. See the guides on revising a submitted UAE VAT return and common VAT return filing mistakes.
What if the VAT return was filed but contains mistakes?
An inaccurate submitted return is different from a return that was never filed. The business should reconcile the submitted VAT201 against its ledgers, invoices, credit notes, imports and payment records, quantify the error and determine the correct FTA correction route. Depending on the facts, the correction may belong in a later return or require a Voluntary Disclosure. The error should not simply be carried forward or offset without documenting why the selected treatment is appropriate.

Missed VAT return FAQs
What happens if I submit a UAE VAT return late?
The filing obligation remains due and the administrative penalty schedule provides a fixed late-return penalty. A first violation is AED 1,000, with a higher fixed penalty on repetition within the applicable repeat period.
Do I still need to file if there were no sales or purchases?
If a VAT return is due for the tax period, no activity does not automatically remove the filing obligation. The FTA return guidance provides for entering zero where there are no amounts to declare.
Is late payment the same as late filing?
No. Late submission of the return and late settlement of VAT payable are separate compliance issues and can have separate consequences.
Should I wait for the FTA to contact me before filing an overdue return?
No. The better approach is to identify the overdue period, reconcile the records and complete the filing promptly rather than allowing additional periods to become outstanding.
Can a company simply stop filing if it no longer trades?
No. If the business believes it should no longer be VAT-registered, it should review the VAT deregistration rules and complete the correct deregistration process rather than simply stopping returns.
